Business and Professions Code section 4882


(a)

The proceedings under this article shall be conducted in accordance with Chapter 5 (commencing with Section 11500) of Part 1 of Division 3 of Title 2 of the Government Code, and the board shall have the powers granted therein.

(b)

Notwithstanding subdivision (a) of Section 11415.60 of the Government Code, a licensee, registrant, or permitholder may enter into a settlement to resolve an administrative action, including through license, registration, or permit surrender, suspension or revocation, or placing the license, registration, or permit on probation, instead of a commencement of proceedings pursuant to Chapter 5 (commencing with Section 11500) of Part 1 of Division 3 of Title 2 of the Government Code. That settlement shall be subject to board approval or a counteroffer of terms of the settlement action. At any time prior to the issuance of a decision and order by the board adopting the settlement, the licensee, registrant, or permitholder may withdraw the settlement and request a commencement of proceedings pursuant to subdivision (a). The decision and order adopting the settlement shall be considered discipline and shall be posted on the board’s internet website.
