Government Code section 65098.9

The provisions of this chapter shall not apply to a logistics use development if it meets both of the following:

(a)

The logistics use development is a mixed-use development that may create sensitive receptors on the site of the new logistics use development.

(b)

There are no existing sensitive receptors within 900 feet of the loading bay.
