Health and Safety Code section 18304

(a)

This part does not apply to any apartment house, hotel, or dwelling which is subject to the provisions of Part 1.5 (commencing with Section 17910) of this division.

(b)

This part does not apply to electric, gas, or water facilities owned, operated, and maintained by a public utility.
