Health and Safety Code section 111395

Any drug is misbranded in any of the following cases:

(a)

It is an imitation of another drug.

(b)

It is offered for sale under the name of another drug.

(c)

The contents of the original package have been, wholly or partly, removed and replaced with other material in the package.
