Health and Safety Code section 104665


(a)

On or before February 1, 2028, and on or before February 1 of each year thereafter through February 1, 2032, any vendor of food or food products to a school shall report the following information to the department for each food product sold to a school in the past calendar year, to the extent it is known to the vendor:

(1)

The total quantity of that food product sold to schools.

(2)

The name of the food product.

(3)

Whether the food product is an ultraprocessed food.

(4)

Whether the food product is a restricted school food or an ultraprocessed food of concern.

(5)

The category or categories of food to which the food product belongs.

(6)

The average total calories in each food product sold to schools that year.

(7)

The ingredient list of the food product.

(8)

The nutritional facts of the food product.

(b)

The requirements of subdivision (a) do not apply to:

(1)

A cottage food operation that is registered or has a permit pursuant to Section 114365.

(2)

A microenterprise home kitchen, as defined in Section 113825.

(3)

A small business, as defined under Section 14837 of the Government Code.

(c)

The failure of a vendor to comply with this section does not create a private right of action.

(d)

This section shall become inoperative on July 1, 2033, and, as of January 1, 2034, is repealed.
