CA Gov't Code Section 8670.36.1


(a)

To reduce the damages and costs from spills, the administrator shall develop an outreach program to provide assistance to the operators of small craft refueling docks.

(b)

The program shall include both of the following:

(1)

Voluntary inspections by the administrator. The administrator shall prepare, and maintain on file, a written report recommending how any risk of a spill identified in those inspections may be reduced and how those recommendations could be implemented.

(2)

An education and outreach program to inform small craft refueling dock operators and the operators of the vessels they serve of the obligations and potential liabilities from a spill. For the purpose of this section, “vessel” has the same meaning as in Section 21 of the Harbors and Navigation Code.

(c)

To ensure effective implementation of the program, each small craft refueling dock shall register with the administrator prior to operating.

(d)

The administrator may require information needed to evaluate whether a facility is a small craft refueling dock as defined in Section 8670.3. The administrator may also require any pertinent information regarding the oil spill risk of a small craft refueling dock. This information may include, but shall not be limited to, the following:

(1)

The type of oil handled.

(2)

The size of storage tanks.

(3)

The name and telephone number of the small craft refueling dock operator.

(4)

The location and size of the small craft refueling dock.

(e)

The administrator may develop regulations to implement this section.
