Government Code section 54999.2

Any public agency providing public utility service on or after July 21, 1986, may continue to charge, or may increase, an existing capital facilities fee, or may impose a new capital facilities fee after that date, and any public agency receiving a public utility’s service shall pay those fees so imposed, except as provided in Section 54999.3 and 54999.35.
